This Privacy Policy explains how we collect, use, process and protect your Personal Information during visits to our Websites (referred to as the "Website"), as well as during the use of the Web application and the "Wizart" mobile applications (jointly referred to as the "Application"). What this Privacy Policy regulates

This Privacy Policy applies to all information, including Personal Information as described in the applicable legislation, which WIZART may receive about you in the course of use of the Website and/or the Application.

What information we collect

In order to send a request via the contact form on the Website, you need to enter your Personal Information, in particular your name, e-mail address, telephone number. To use the functional capabilities of the Application regarding the application of finishing materials in your interiors, you need to upload images from a gallery into the Application or take a photograph of your interior using the Application. You are under no obligation to provide us with information of any nature, but your refusal to do so may impede your use of certain functions of the Application.

We use cookie files produced by third parties such as Google (for instance, Google Analytics cookies) to collect data on the Users' interaction with the Website and the Application. This information does not include your name, e-mail address, telephone number or other high-accuracy data about your location. The cookie files contain information that is collected from your device and sent back to the Website or the Application in order to keep track of your actions and preferences as time goes by.

 

When we collect information

We collect information in the following cases: 

  •  When the User sends a request or application via the contact form on the Website;
  •  When the User uploads images from a phone gallery into the Application or when photographs are taken with the help of the Application for further processing. ​ When you provide your Personal Information while sending a request or application via the Website, and when you upload your photographs into the Application or take photographs with the help of the Application, you give consent for the collection, processing, storage and use of this information by WIZART.

When entering the Website or the Application, you also give consent for the collection, processing, storage and use of information obtained by means of analytics tools (for instance, Google Analytics). We recommend that you peruse the privacy policies of the makers of said analytics tools and directly contact them to get answers to whatever questions you may have. Legal basis and purposes of the processing of your Personal Information

WIZART has no right to process your Personal Information without the appropriate legal basis. Therefore, WIZART processes your Personal Information only in the following events: 

  •  when you give us consent to process your Personal Information by accepting this Privacy Policy, Terms of Use and our Cookie Policy when prompted while visiting this website and/or using Wizart products. ​ WIZART processes your Personal Information for the following purposes: 
  • to process your requests and applications sent via the Website's contact form; 
  • to improve the convenience of use of the services provided by WIZART. ​

We use images uploaded by the User from a device's gallery into the Application, or photographs taken with the help of the Application, to apply the selected product types in your interior to teach neural networks and algorithms that form the basis of the Application's operation, and to improve the quality of future results of image processing.

 

Personal Information storage

WIZART shall store your Personal Information within the period of time necessary to achieve the above-mentioned purposes, and in accordance with the requirements of the acting legislation.

 

Transfer of Personal Information to third parties

WIZART may also transfer Personal Information to third parties in the following events: 

  • if the transfer Personal Information is required to execute a specific agreement or contract made with you;
  • if Personal Information is to be transferred to any national and/or international regulatory body, law enforcement authorities, central or local executive authorities, other official or state authorities or courts, in regard to which WIZART is obliged to provide information in accordance with the applicable legislation upon receiving a request to that effect; 
  • if Personal Information is to be transferred to any third party for the purposes of legal defense of WIZART or third parties in the event that you violate this Privacy Policy or the Terms Of Use of the Website and/or the Application.

 

Protection of Personal Information

To protect Personal Information against unauthorized, accidental or illegal destruction, loss, modification, dishonest use, disclosure or access, as well as other illegal forms of processing, WIZART has implemented the following technical and organization measures: 

  •  provision of access to your Personal Information only to those WIZART employees who require it to perform their duties; 
  • use of open source software; 
  • use of intrusion detection and prevention systems embedded into network firewalls; 
  • location of equipment for Personal Information processing within secure premises and preservation of security devices and alarm systems in a state of constant readiness.
  • all of the Personal Information provided via website's contact form is secured by HTTPS/TLS protocols and the Personal Information provided while using Wizart products is secured by Algorithm AES and PKCS7.

 

Your rights

You have the right: 

  • to demand the removal of your Personal Information provided via the contact forms of the Website or the Application, as well as images that you have uploaded into the Application; 
  • to demand modification of inaccurate or incomplete Personal Information;

GDPR Compliance

Below is the overview of Wizart's GDPR compliance: 

  • Lawful basis (art. 6 and art. 11 GDPR). The lawful basis is consent, Data Subject consents to Wizart’s data collection about them. 
  • Processing children’s personal data (art. 8 GDPR). Wizart does not distinguish between different types of Personal Information and does not knowingly collect children’s Personal Information.
  • Data protection by design (art. 25 GDPR). Wizart collects the minimum Personal Information necessary to carry out normal business operations. Wizart encrypts and securely stores collected Personal Information. Personal Information collected while using Wizart's products is anonymized. 
  • Data Protection Impact Assessments (art. 35 GDPR). Wizart appointed Data Protection Officer (DPO) to perform any necessary Data Protection Impact Assessments. Wizart's DPO can be contacted at . 
  • Encryption (art. 32 GDPR). Personal Information provided via website's contact form is secured by HTTPS/TLS protocols and the Personal Information provided while using Wizart products is secured by Algorithm AES and PKCS7. 
  • Personal data inventory (art. 30 GDPR). Wizart maintains a record of processing activities under our responsibility. 

Right of erasure and other rights of the data subject (art. 12-18, art. 20-21). Wizart appointed Data Protection Officer (DPO) to respond to any exercise of the right of erasure and any other rights provided for by the GDPR Regulation.

The Website provides the User with a possibility to view detailed information about WIZART, the Application, to access the Application, as well as a possibility to contact WIZART regarding partnership or investments.

 

Gaining access to the Application

The following ways can be used to gain access to the Application or enter the Website: 

  •  follow a link to the Application on the Website or enter a direct link to the Application or Website in the URL bar; 
  • download the Application on the AppStore and/or Google Play.

 

Your information in the Application and on the Website

The User gives WIZART consent for processing of the User's Personal Information as defined in the Privacy Policy, for the purposes of provision of the functional capabilities of the Website and the Application.​ The User agrees that images or photographs uploaded by them into the Application from their device's gallery, as well as photographs taken by the User in the Application, may be used by WIZART for processing and provision of results to the User. Furthermore, the User acknowledges and agrees that WIZART has no obligation to view the received images, and the use thereof by the specified means for the specified purposes can be done automatically using software. In case the User is not in the position to grant to WIZART the right to use any image or photograph in such a way, they must refrain from using these images in the Application.

WIZART performs processing of the User's Personal Information and other information uploaded and provided by the User by means of the Application, based on these Terms Of Use and the Privacy Policy, both of which are available on the Internet at . If you send us reviews and comments regarding the operation of the Website or the Application, we reserve the right to carry them out without accepting any obligations to the author thereof.

 

Limitations

The Application, as well as materials about the Application on the Website, may be temporarily downloaded and used for personal, non-commercial purposes. Unless otherwise noted in the agreement with WIZART you may not: ​ 

  •  modify or copy the materials published on the Website and/or in the Application; 
  • use materials and the Application for any commercial purposes or for any public demonstration (commercial or non-commercial);

The use of the Application under these Terms Of Use for personal, non-commercial purposes is carried out free of charge. The use of the Application under these Terms Of Use for commercial purposes is possible in case it is stipulated in the agreement with WIZART. Any use of the Application in a way not envisioned by these Terms Of Use is only possible on the basis of an additional agreement with WIZART.

 

Liability regarding the Website and the Application

Liability for the provision of information on manufacturers, their product types and samples, as well as images of said product samples (jointly referred to as the "Information Object") to WIZART shall be completely placed on the partners (manufacturers who provided us with materials on the Information Objects in electronic form). The Information Objects provided in the Application may include technical, typographic or photographic errors. WIZART does not guarantee that any of the Information Objects in the Application are in stock at stores of the partners (manufacturers whose Information Objects are provided in the Application). These Information Objects may be modified at any time without prior notice. However, WIZART does not accept any obligations regarding the constant updating of Information Objects in the Application. WIZART shall not be liable for lost profits, foregone earnings, loss of data, financial losses, as well as collateral, special, indirect, punitive and other losses of the partners or Users resulting from the use or inability to use the Application, even if the official representative of WIZART has been informed verbally or in writing about the possibility of such damages.

The Site and the Application may contain links to websites that belong to or are operated by parties other than WIZART. WIZART does not control third-party websites and bears no responsibility for the content of any such websites. You are strongly encouraged to examine their privacy policy and terms and conditions of use, and directly contact them to receive answers to your questions.
